The Education Act 1996 requires that:
1. Governors must 'have regard to' the 'Code of Practice on the Identification and Assessment of Special Educational Needs' approved by Parliament and distributed to all schools. OFSTED inspectors are required to include SEN provision in their report.
2. Governors must publish their policy on SEN, include the policy in their school prospectus and report on the implementation of the policy in their annual report to parents. Pages 8 and 9 of the 'Code of Practice' are attached since they set out the requirement for both the policy and report to parents.
3. The SEN policy for a Catholic School must reflect the distinctive character of Catholic education and it is intended that the model attached, though not prescriptive, will help governors in preparing their own policy. It is a strong recommendation that governors attach the Diocesan Statement on Special Educational Needs to their own policy.
